Juveniles go through a separate court system, the juvenile court , which sentences or commits juveniles to a certain program or facility. Once processed in the juvenile court system there are many different pathways for juveniles. Some juveniles are released directly back into the community to undergo community-based rehabilitative programs, while others juveniles may pose a greater threat to society and to themselves and therefore are in need of a stay in a supervised juvenile detention center. Secure detention means that juveniles are held for usually short periods of time in facilities in order to await current trial hearings and further placement decisions. Juvenile detention is not intended to be punitive. Rather, juveniles held in secure custody usually receive care consistent with the doctrine of parens patriae , i.

Teen Court is a diversion program offered to first time juvenile offenders in which they admit to their involvement in the offense and agree to have their case heard before a peer jury of Teen Court student volunteers in a court setting. The judges, which include Circuit, District, and Special Appeals judges, volunteer their time and are present to answer legal questions and set the tone for the courtroom. Using Teen Court guidelines, the jury decides the appropriate disposition which includes mandatory community service hours, appropriate educational programs, and may include essays, apology letters, or Teen Court jury duties.

The program is set up for first-time, non-violent youth offenders. The teenaged defendant was testifying about being caught with a vaping device at school and how it was not the first time. His attorney, Olivia Hanson, a Quincy High School student, asked him about the punishment that he has already received for using the vaping device at school and if he planned on continuing to use a vaping device or socialize with friends who have a vaping device. Ginter, a freshman criminal justice major at Quincy University, made sure to go through the previous times he had been caught and why he thought it would be different this time. Hanson and Ginter volunteered as the defense attorney and prosecutor respectively for a session of the Adams County Teen Court where a group of teenaged volunteers serving as the jury decide a sentence for those who enter the program.
